TERMS & CONDITIONS

1. Introduction

The Collectible Conservancy ("TCC") acts as a third-party facilitator, assisting clients in submitting comic books and magazines ("collectibles") to CGC Comics ("CGC") for grading. These Terms & Conditions ("terms") govern the relationship between TCC and its clients ("clients") regarding this service.

2. Eligibility and Acceptance

By using TCC's services, you represent and warrant that:

  • You are at least 18 years old or otherwise legally capable of entering into a contract.

  • You are the legal owner of the collectibles or have been authorized by the legal owner to submit them for grading.

  • You have read and understood these Terms and agree to be bound by them.

3. Services and Fees

TCC offers various service packages for submitting collectibles to CGC. Each package includes specific services, such as:

  • Secure packaging and transportation of collectibles.

  • Completion of CGC submission forms.

  • Payment processing for CGC grading fees.

TCC's fees are based on the service package chosen and the value of the collectibles. Additional fees may apply for specialized services or handling of high-value items. All fees are non-refundable once TCC receives the collectibles.

4. Client Responsibilities

Clients are responsible for:

  • Ensuring the collectibles are authentic and not forgeries or tampered with.

  • Accurately declaring the value of the collectibles for insurance purposes.

  • Providing clear instructions for any special handling or requests regarding the collectibles.

  • Maintaining a valid email address and phone number for communication.

5. Disclaimers and Limitations of Liability

TCC acting as a facilitator is not responsible for:

  • Any damage or loss to collectibles occurring during CGC's grading process or return transport.

  • The CGC grading assigned to the collectibles.

  • Any delays or errors caused by CGC or third-party shipping companies.

  • TCC's total liability for any claim arising from these terms shall not exceed the value of the collectibles declared by the client.

When TCC is acting as a presser/conservator, the client acknowledges and accepts the risk for potential of damage, and that TCC and its owners or agents will not be held legally or monetarily responsible or liable for damage to any book caused by the handling or processes performed by TCC.

While it is very rare that a book will incur damage from any of the processes performed by TCC, there is the potential for it to occur. TCC will take all necessary precautions to prevent any damage from occurring. However, in the event damage does occur, TCC will make all possible efforts to find a resolution that will be satisfactory.

TCC cannot guarantee that a book after undergoing our services will result in higher grade.

6. Insurance

TCC provides standard insurance coverage for collectibles while in its possession and during transit. Clients may opt for additional insurance at their own expense.

7. Cancellation and Returns

Once TCC receives the collectibles, cancellation is not possible, and fees are non-refundable. TCC does not accept returns of graded collectibles from CGC.

8. Indemnification

Clients agree to indemnify and hold harmless TCC from any and all claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or relating to the collectibles or client's breach of these terms.

9. Dispute Resolution

Any dispute arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in New Jersey, and the prevailing party shall be entitled to recover its reasonable attorneys' fees.

10. Force Majeure

TCC shall not be liable for any delay or failure to perform its obligations under these terms due to causes beyond its reasonable control, such as acts of God, natural disasters, strikes, or governmental regulations

11. Governing Law and Severability

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey. If any provision of these terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These terms constitute the entire agreement between TCC and the client with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Changes to Terms

These terms constitute the entire agreement between TCC and the client with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

TCC serves the right to change these terms at any time by posting the revised terms on its website. Your continued use of TCC's services after the posting of revised terms constitutes your acceptance of the revised terms.
